These Terms of Service ("Terms") form a binding legal agreement between you and Alizia Kumail, operating as a sole proprietor in New Delhi, India ("Annotate", "we", "us", "our"). They outline the rules for using the Annotate mobile app and its connected services (the "Service"). By creating an account or using Annotate, you agree to follow these Terms.
While Annotate is built collaboratively by two people, responsibility for your personal data belongs solely to Alizia Kumail, who has exclusive access to the production databases, as detailed in our Privacy Policy.
You must be at least 13 years old to use Annotate, or 16 years old if you live in the European Economic Area (EEA) or the UK. By creating an account, you confirm you meet this requirement. You are responsible for keeping your account password secure and for any activity that happens under your account.
You own your content. We do not claim ownership of the reviews, annotations, or profile text you post ("Your Content").
To operate the Service, you grant us a worldwide, royalty-free license to
host, format, and publicly display Your Content. This license ends when
you delete your content or your account, with two practical exceptions:
(1) if people have replied to your comments, a blank
[deleted] placeholder may remain so the conversation stays
readable, and (2) factual book metadata corrections you submit are
permanently integrated into our shared global catalog.
Annotate is a shared public space. We maintain a zero-tolerance policy for abusive behavior and objectionable content. You agree not to post content that:
Reporting and Enforcement: You can block users or report violating content directly in the app. We review all reports and take action — which may include content removal or immediate account termination — within 24 hours. We reserve the right to ban users at our discretion to keep the community safe.
Annotate allows you to read your own EPUB files. These files are processed entirely on your device and are never uploaded to our servers. Because they are local to your device, they are not backed up by us; if you delete the app or lose your phone, you will need to re-import them. You are solely responsible for ensuring you have the legal right to read any file you import. Do not use Annotate for piracy.
If you believe your copyrighted work is being infringed upon within the app, email [email protected] with a description of the original work, where the infringing content is located in the app, and a statement that you are the authorized rights holder. We will remove the material and terminate the accounts of repeat offenders.
We provide the Service "as is" and "as available." We make no promises that Annotate will always be error-free, secure, or uninterrupted. We are not responsible for the opinions other users express in their reviews.
To the fullest extent permitted by law, we will not be liable for any indirect or incidental damages, or for any loss of data or reading progress. Our maximum liability to you for any claim related to the Service is limited to fifty US dollars ($50).
If you download Annotate from the Apple App Store, the following terms apply: This agreement is between you and Annotate, not Apple. Apple is not responsible for the app or its content, nor are they obligated to provide support. If the app fails to meet any warranty, you can notify Apple for a refund of the purchase price; Apple has no other warranty obligations. Apple is not responsible for addressing legal claims, product liability, or intellectual property infringement regarding the app. You confirm you are not located in a US-embargoed country or on a US restricted list. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
Governing Law: These Terms are governed by the laws of India, and any disputes will be resolved in the courts of New Delhi. If you are a consumer in the EEA or the UK, you still retain the mandatory consumer protections of your home country.
Termination: You can end this agreement anytime by going to your Settings and deleting your account. We may suspend or terminate your account if you violate these Terms.
