Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Developer, operating as a sole proprietor based in Developer, India ("Annotate", "we", "us", "our"). They govern your use of the Annotate mobile application and the services behind it (together, the "Service"). By creating an account or otherwise using the Service, you confirm that you accept these Terms. If you do not accept them, please do not use the Service.

Annotate is developed collaboratively by two people, and responsibility for your personal data is shared between them as described in our Privacy Policy. These Terms, however, are an agreement between you and the sole proprietor named above, who operates the Service.

1. Who Can Use Annotate

You must be at least 13 years old to use the Service, and at least 16 years old if you reside in the European Economic Area (EEA) or the United Kingdom. We enforce the higher threshold in Europe because we do not operate a parental consent mechanism. If you are below the age of majority where you live, please review these Terms together with a parent or guardian.

You may not use the Service if you have previously been removed from it, or if any law that applies to you prohibits your use of it. By using the Service, you confirm that you have the legal capacity to enter into these Terms.

2. Your Account

You need an account to use most of the Service. You agree to provide accurate information, to verify your email address when asked, and to keep your password confidential. You are responsible for all activity that occurs under your account. Please contact us at [email protected] immediately if you believe someone else has gained access to it.

One person, one account. You may not create accounts to impersonate another person, to evade a block placed by another user, or to evade a suspension or removal by us.

3. Your Content and the Licence You Grant Us

"Your Content" means everything you post or upload: reviews, annotations, comments, your profile text and images, shelf names, and anything else you create within the app.

You retain all ownership of Your Content. We claim no ownership over it. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting and display purposes, and publicly display Your Content, solely for the purpose of operating, promoting within the app, and improving the Service. This licence exists only so that we can display your posts to other users and maintain working copies and backups. It terminates when you delete the content or your account, with two exceptions: copies may persist briefly in backups as described in the Privacy Policy, and detached [deleted] placeholders may remain where other people have replied to your comments.

You confirm that you hold the rights necessary to post Your Content and that it does not infringe the rights of anyone else. Quoting a passage from a book in order to annotate or review it is normal and expected. Reproducing substantial portions of a copyrighted work is not.

Book Catalogue Contributions

If you submit a correction to book metadata through the librarian tools, you agree that the correction becomes part of the shared book catalogue that all users depend on, and that it may remain in that catalogue permanently, including after you delete your account. Factual book metadata is not owned by anyone, and the catalogue would break if corrections vanished whenever a contributor left.

4. Annotate Is Public

The Service does not currently offer private accounts. Your profile, reviews, annotations, comments, shelves, reading progress, and follow lists are visible to every other user. Profile and banner images are served from a public media domain and can be opened by anyone holding the direct link. Please post accordingly. The Privacy Policy sets out precisely what is public and what is not.

5. Rules of Conduct

There is no tolerance for objectionable content or abusive behaviour on Annotate. You agree not to post, upload, or transmit content, and not to behave in a manner, that:

Spoilers are not a conduct violation, but please mark them using the spoiler toggle. It exists so that other readers can choose for themselves.

6. Reporting, Blocking, and Enforcement

You can report any annotation, review, comment, or account directly from the place it appears in the app, and you can block any user from their profile. Blocking is silent: the person you block is not notified. You may also report content to us by email at [email protected].

Reports reach us immediately. We review them and act on objectionable content and abusive users within 24 hours of the report. Action may mean removing the content, restricting an account, or removing the user from the Service entirely. We may act without prior notice where we believe it is necessary to protect someone, and we may also act on violations we discover ourselves.

Where we remove your content or restrict your account, we will tell you what we removed or restricted and why, unless we are legally prevented from doing so or the account was created purely to abuse the Service. If you believe we got it wrong, reply to that notice or email [email protected], and a human being will review the decision again. We aim to respond to appeals within seven days.

Please do not abuse the report system. Filing reports in bad faith, for example in order to harass someone, is itself a violation of these Terms.

7. Books You Import

Annotate lets you open EPUB files that you already have. Those files are stored only on your own device, in the app's private storage. We never receive, upload, host, or have any access to them, and our servers retain only the file name so that the app knows a book has a file attached.

You are responsible for holding the right to possess and read any file you import. Do not use Annotate with pirated books.

Because those files live only on your device, they are not backed up. If you delete the app, switch phones, or your device fails, the files are gone and we cannot restore them. Please keep your own copies.

8. Copyright and Trademark Complaints

If you believe that content on Annotate infringes your copyright or trademark, please email [email protected] with:

We will investigate and remove infringing content. If your content is removed following such a notice and you believe the removal was mistaken, you may send us a counter-notice at the same address explaining why, and we will consider restoring it. We terminate the accounts of repeat infringers.

9. Third-Party Services and App Stores

Book search results, cover images, and book metadata come from third-party sources including the Google Books API. We do not control that data and cannot guarantee that it is accurate or complete. Your use of the Service may also depend on third-party infrastructure that we rely on to host and deliver it.

You obtain the Annotate app through the Apple App Store or Google Play. Those stores are not parties to these Terms and are not responsible for the Service. Your use of the app must also comply with the applicable store's own terms of service.

Additional terms for the Apple App Store. These Terms are between you and us only, not with Apple. Apple has no obligation to furnish any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes that party's intellectual property rights. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

10. Fees and Paid Features

Annotate is currently free. There are no subscriptions, no purchases, and no advertising. If we ever introduce paid features, we will describe the price and what you get before you buy anything, we will never convert an existing free feature into a paid one without notice, and any purchase will be processed by the Apple App Store or Google Play under their payment and refund rules rather than by us directly. We will update these Terms before any such feature launches.

11. The Service Itself

Annotate is early-stage software, currently in testing. Features will change, break, and occasionally disappear. We may modify, suspend, or discontinue any part of the Service at any time. If we ever shut the Service down entirely, we will give you reasonable notice and an opportunity to retrieve your data.

You are responsible for your own device, your internet access, and any charges levied by your carrier or app store.

12. Ending Things

You can delete your account at any time from Settings → Delete account. Deletion is immediate and permanent, subject to the limited exceptions described in Section 3 and in the Privacy Policy. You may also simply stop using the Service.

We may suspend or terminate your account if you breach these Terms, if your conduct exposes us or other users to legal risk or harm, or if we are required to do so by law. Where it is reasonable, we will tell you why and you may appeal as described in Section 6.

Sections 3 (as to licences already granted), 8, 13, 14, 15, 16, and 17 survive termination of these Terms.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error free, or that data will never be lost.

We are not responsible for content posted by other users. Opinions expressed in reviews and annotations belong to the people who wrote them.

14. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or reading progress, arising out of or relating to your use of the Service.

Our total aggregate liability to you for all claims relating to the Service is limited to the greater of (a) the total amount you have paid us in the twelve months before the claim arose, or (b) USD 50. Annotate is currently free, so in practice this means USD 50.

Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for anything else that applicable law does not permit us to exclude.

15. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable legal costs arising from Your Content, your use of the Service, or your breach of these Terms. This does not apply to the extent that the claim arises from our own wrongdoing, and it does not apply where you are a consumer and applicable consumer law provides otherwise.

16. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law rules. The courts of New Delhi, India have exclusive jurisdiction over any dispute, and you and we both consent to that jurisdiction.

If you are a consumer in the European Economic Area or the United Kingdom, nothing above deprives you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your local courts. EU consumers may also use the European Commission's online dispute resolution platform.

Before starting formal proceedings, please contact us at [email protected]. Most disputes can be resolved quickly and informally, and we would much rather fix the problem than argue about it.

17. General

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer these Terms to anyone else; we may transfer them to a successor if Annotate is ever acquired or incorporated, and we will tell you if that happens. These Terms and the Privacy Policy together form the entire agreement between you and us regarding the Service.

18. Changes to These Terms

We may update these Terms as the Service develops. We will update the "last updated" date above, and for material changes we will notify you in the app before they take effect and ask you to accept them again. Continued use after a change takes effect means you accept the updated Terms. If you do not accept them, you can delete your account.
